MERSEYPEST Service Agreement Terms & Conditions
To ensure that all pest management work is carried out in accordance with industry codes of practice and regulations and with due attention to consumers, employees and the environment.

- To attend to consumer complaints promptly and ensure that these are resolved.

Contract Terms & Conditions
1. THE CUSTOMER
THE CUSTOMER means the customer as specified at the top of the Service Agreement.
2. Payments
THE CUSTOMER will make payments to MERSEYPEST as agreed in the Service Agreement. Prompt payment is a condition of the agreement.
3. MERSEYPEST obligations – Pest Control Service
a) The pest control service will be carried out in a professional manner at regular intervals as specified in the service agreement. The technician will use and apply pesticides and monitoring devices, as they deem appropriate on each visit. Any infestation covered by the agreement and discovered during a visit will be treated immediately if safe to do so and if the appropriate control equipment is on board the technicians vechicle.
b) The technician will report to the site contact on each visit and will leave a written report on the findings, treatments and recommendations made during the inspection.
c) Additional visits/treatments to control the pests specified on the service agreement will be carried out free of charge on the provision THE CUSTOMER has adhered to all previous recommendations in accordance with site visit reports. Failure to comply will result in additional charges to THE CUSTOMER for any additional site visits or materials required to resolve any pest infestation issues.
d) All equipment supplied onsite as part of the contract will remain the property of MERSEYPEST unless purchased by the client. Any damages will result in a charge being levied to THE CUSTOMER.
4. THE CUSTOMERS obligations – Pest Control Service
a) To minimise pest infestations by ensuring that the previous recommendations made by the pest control technician are adhered to. Failure to comply will result in additional charges to THE CUSTOMER for any additional site visits or materials required to resolve any pest infestation issues.
b) Ensure all areas are kept clean and tidy at all times. Food to be stored in suitable containers and no food debris on floor or surfaces.
c) Responsible for ensuring all windows and doors are closed where required, fitting of fly proof screens where applicable in accordance with the Food Safety Act. MERSEYPEST can provide this service if required at cost to THE CUSTOMER.
d) To provide full access for MERSEYPEST representatives to carry out its services during the normal working hours of 8am until 5pm Monday to Friday, unless by prior written agreement.
e) Report any signs of definite pest activity to MERSEYPEST immediately. If the pest activity is not covered by the contract you should still contact MERSEYPEST to inform us of the issue, where a survey can subsequently be carried out and a cost can be provided to resolve the issue if additional services are needed.
f) Removal and disposal of dead rodent carcasses or insects etc are the responsibility of THE CUSTOMER. MERSEYPEST may agree to remove carcasses via a call-out charge on provision that accessibility is suitable, this cost will be payable by THE CUSTOMER.
g) THE CUSTOMER is responsible of ensuring no persons/animals enter the treated areas where liquid insecticides/fumigants have been applied. Isolation times will be advised on the related service reports.
h) All equipment supplied onsite as part of the contract will remain the property of MERSEYPEST unless purchased by the client. Any damages will result in a charge being levied to THE CUSTOMER.
i) To make prompt payment to ensure no delays in site servicing.
5. MERSEYPEST obligations – Fly Control Units
a) Sale of fly control units includes delivery to the customers site.
b) Installation is not included with the sale of the fly control unit and THE CUSTOMER will be made aware of this at the point of sale. If installation is required an additional cost will be incurred, payable by THE CUSTOMER. Fly control units will require a plug socket to be available on arrival in the appropriate fitting area.
c) A maintenance contract covers annual replacement of the ultra violet tubes and starters. THE CUSTOMER will receive between one (1) to four (4) visits per year to inspect, clean and test the unit(s). See contract agreement.
6. The CUSTOMERS obligations – Fly Control Units
When a maintenance contract exists, THE CUSTOMER must take reasonable care of the unit(s) installed in their premises: Damage over and above the normal wear and tear will result in a charge being levied and the manufacturers warranties being invalidated if the affected Fly Control Unit has been supplied by MERSEYPEST.
7. TREATMENT
For avoidance of unnecessary call-outs please note:
In the case of Wasps, Flies, Fleas, Bedbugs, Garden Ants and other crawling insects, insecticides applied will have immediate effect in reducing insect activity. However, this is dependent upon the insects present at the time of treatment. A presence of insects a few hours or days after treatment is normal and should not cause alarm.
In the case of treatment against rodents such as Rats, Mice or Squirrels, a few days will elapse after application of bait and/or traps before the treatment will become effective. MERSEYPEST do not remove carcasses from premises unless easily accessible and/or previously agreed. We can however remove/find them for a charge levied to the CUSTOMER.
8. LIABILITY
MERSEYPEST does not accept any liability for loss, damage or injury to any domestic animals, livestock, birds, goods or equipment unless the loss, damage or injury was caused by negligence of MERSEYPEST. Notice of loss, damage or injury must be notified in writing by THE CUSTOMER to MERSEYPEST within seven (7) days of occurrence. Failure of notification will result in MERSEYPEST not being liable for any loss, damage or injury.
9. TERMINATION
This contract may be terminated by MERSEYPEST forthwith if THE CUSTOMER is in breach of any of his/her obligations under this contract; or (being a Company) goes into liquidation; or if THE CUSTOMER shall commit an Act of Bankruptcy; or have any receiving order made against him/her; or shall make any arrangement with his/her creditors or any assignment for the benefit of such creditors; or if distress or execution shall be levied or threatened upon any of THE CUSTOMERS property or any judgement against THE CUSTOMER shall remain unsatisfied for more than fourteen(14) days. THE CUSTOMER may only assign the burden of this contract with the written consent of MERSEYPEST.
The service agreement is binding for one year from date of commencement. This is a annual rolling contract which unless terminated at the end of the first year, with three(3) months written notice as a requirement of termination to the contract. Failure to supply written notice within three(3) months in advance will result in full payment of the remaining annual contract to be settled immediately.
10. THE CONDITIONS
The conditions 1 to 10 above, together with the entire agreement between MERSEYPEST and THE CUSTOMER are contractual, any other alleged terms being expressly excluded.
Change in Terms & Conditions may be applied by MERSEYPEST at any time with a three (3) month notification being issued to THE CUSTOMER in writing.
